Terms of Service

South Florida Realty Management is the registered Florida fictitious name of Joe's Real Estate, Inc., a Florida for-profit corporation (Florida Department of State Document Number P09000057619; FEI/EIN 27-0512864; Florida Fictitious Name Registration G10000072294). For purposes of these Terms of Service (the "Terms"), the terms "South Florida Realty Management," "SFRM," "the company," "we," "us," and "our" all refer to Joe's Real Estate, Inc., doing business as South Florida Realty Management. Joe's Real Estate, Inc. is a licensed Florida real estate broker.

These Terms govern your access to and use of the website located at floridapm.net (the "Site"), our text-message communications, our AI receptionist phone service, and any related online services we provide. By accessing the Site, providing information through any of our web forms, calling our published business number, or otherwise engaging with our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Acceptance of Terms

These Terms form a binding agreement between you and South Florida Realty Management. By using the Site, communicating with us by phone, providing your mobile telephone number for text-message communications, or otherwise engaging with our services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Site and Services

The Site provides informational content about SFRM's services, including residential and commercial property management, multi-family property management, commercial association management, real estate brokerage services, and tenant leasing. Through the Site you may, among other things: browse available rental listings, submit rental applications, contact our team through web forms, access partner-hosted resident and owner portals, and request a property-management proposal.

The Site itself does not constitute a property management agreement, a real estate brokerage agreement, a lease, an offer, or any other contract for services. Engagement of SFRM for any service requires a separately executed written agreement between SFRM and the customer or client.

3. Eligibility

To use the Site or our other services, you must be at least 18 years of age and a U.S.-based user. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate.

4. Text Message Communications

4.1 Program Description

By providing your mobile phone number to South Florida Realty Management — whether verbally during a phone call with our AI receptionist or staff, or in writing through one of our web forms — you agree to receive text messages from us relating to your inquiry, rental application, tenancy, owner account, or property management relationship. Messages may include:

SFRM does not send marketing or promotional text messages. All text messages we send are transactional and responsive to your direct interactions with our team.

4.2 Consent

Consent to receive text messages from SFRM is collected at the point you provide your mobile number. Consent is not a condition of any purchase, lease, rental application, or service. You may decline to receive text messages without any effect on your rental application, tenancy, ownership relationship, or other dealings with SFRM.

4.3 Message Frequency

Text message frequency varies based on your activity with us. We send messages only in response to your direct interactions with our team and do not send recurring marketing messages.

4.4 Costs

Standard message and data rates may apply, depending on your mobile carrier and plan. SFRM does not charge for the text messages we send.

4.5 Opt-Out (STOP)

You may opt out of receiving text messages from SFRM at any time by replying STOP to any message we send. After you reply STOP, we will send a single confirmation that you have been unsubscribed, and we will not send any further text messages to that number. To resubscribe at a later date, reply START to a previously received message or contact us to be re-enrolled.

4.6 Help (HELP)

For help, reply HELP to any of our messages, or contact us at info@floridapm.net or (772) 220-0844. We will respond with assistance information.

4.7 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Messages may be delayed or undelivered due to factors outside SFRM's control, including network congestion, technical issues, signal strength, or your handset.

4.8 SMS Eligibility

To receive text messages from SFRM, you must be a U.S.-based mobile subscriber, at least 18 years of age, and the authorized user of the mobile phone number you provide.

4.9 Supported Carriers and Changes

Our SMS messaging is delivered via the major U.S. wireless carriers and most regional and MVNO carriers. We cannot guarantee delivery on every carrier or device. SFRM reserves the right to modify or discontinue, temporarily or permanently, any text messaging program at any time, with or without notice. We will not modify these Terms in a way that affects your prior consent without notifying you.

4.10 Mobile Information Privacy

Information you provide in connection with our text messaging program is handled in accordance with our Privacy Policy. SFRM does not sell, rent, lease, or otherwise share your mobile phone number, text message content, or opt-in consent record with any third party for that third party's marketing or advertising purposes, and we do not share this information with our affiliates for their marketing purposes.

5. AI Receptionist and Telephone Communications

When you call our published business number, your call may be answered by an AI-powered virtual receptionist that is configured to triage calls, answer factual questions about our services, capture caller information for follow-up, and route urgent matters appropriately. By continuing your call, you acknowledge that:

Your use of the Site and our services is also governed by our Privacy Policy. The Privacy Policy describes the information we collect, how we use it, who has access to it, and the rights you have with respect to your information. The Site and its content — including all text, graphics, logos, images, photographs, videos, software, and the selection and arrangement thereof — are the property of SFRM or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

SFRM grants you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use, subject to these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or otherwise exploit any of the Site content without our prior written permission.

Third-party trademarks and service marks appearing on the Site (including those of NARPM, the Florida Realtors association, Realtor MLS, and any partner platforms we link to) are the property of their respective owners and are used with permission or under fair use.

9. Real Estate and Property-Management Disclaimers

The Site is provided for informational purposes only. Information on the Site — including rental listings, qualification criteria, fee ranges, service descriptions, and policies — is subject to change without notice. Specific terms applicable to any rental, management agreement, or brokerage engagement are governed by separately executed written agreements between SFRM and the customer or client, not by content on the Site.

Nothing on the Site constitutes legal, tax, accounting, financial, or investment advice. You should consult appropriately licensed professionals for advice specific to your situation.

Rental listings, pricing, availability, and property-specific details (including but not limited to move-in costs, security deposits, pet policies, and lease terms) are property-specific and subject to change without notice. Authoritative current information is available on each property's individual listing.

10. Fair Housing Notice

South Florida Realty Management is fully committed to compliance with the federal Fair Housing Act and all related federal, state, and local fair housing laws. We do not discriminate, and will not tolerate discrimination, against any person on the basis of race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, or disability. All qualified applicants are welcomed and evaluated on the basis of our objective, equally applied qualification criteria.

11. Third-Party Links and Services

The Site may contain links to third-party websites and services (including, without limitation, managebuilding.com, showmojo.com, our SMS messaging platform vendor, and our background-check vendors). These third parties operate independently and have their own terms of service and privacy policies. We are not responsible for the content, accuracy, practices, or policies of any third-party website or service. Your use of any linked third-party site is at your own risk and subject to that site's terms.

12. Disclaimer of Warranties

The Site and our services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, SFRM disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade.

SFRM does not warrant that the Site or our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. SFRM does not warrant the accuracy, completeness, reliability, or timeliness of any content on the Site.

13. Limitation of Liability

To the maximum extent permitted by applicable Florida law, in no event shall SFRM, its officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of (or inability to use) the Site or our services, even if SFRM has been advised of the possibility of such damages.

To the maximum extent permitted by applicable Florida law, SFRM's total cumulative liability arising out of or related to these Terms, the Site, or our services shall not exceed one hundred U.S. dollars ($100), or the amount you paid to SFRM in the twelve months immediately preceding the event giving rise to the claim, whichever is greater.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or fraud.

14. Indemnification

You agree to indemnify, defend, and hold harmless SFRM and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Site or our services, or (c) your violation of any rights of any third party in connection with your use of the Site or our services.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms, the Site, or our services shall be brought exclusively in the state or federal courts located in Martin County, Florida, and you consent to the jurisdiction and venue of those courts.

16. Modifications to These Terms

SFRM may modify these Terms from time to time. When we do, we will update the "Last Updated" date below. Material changes will be reflected by a corresponding update to the date and, where appropriate, additional notice on the Site. Your continued use of the Site or our services after a modification becomes effective constitutes your acceptance of the modified Terms. If you do not agree to a modification, your sole remedy is to stop using the Site and our services.

17. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. These Terms, together with the Privacy Policy and any separately executed written agreement between you and SFRM, constitute the entire agreement between you and SFRM with respect to the Site and our services and supersede all prior or contemporaneous understandings on that subject.
